As I tried to make clear in my original post, seizure and forfeiture are two separate things. A seizure is the taking of the item by the government, while forfeiture is the legal process by which the government takes ownership.

Yes, the government could have seized the servers. But Carpathia and Cogent would have fought the forfeiture, and probably would have won. They were simply leasing server space to what they thought was a legitimate company. They can't be expected to be responsible for every file stored on their servers by their clients. That's like holding the bank responsible for what someone keeps in their safety deposit box. In the end it wasn't in the government's best interests to seize all of the servers and store them only to give them back later.

I was talking more about my experience on the federal level, so I'm not sure how state and local laws work on the issue.
I think you're a bit confused. The government could have legally seized the servers for the duration of the trial. Whether or not they could have forfeited them is another matter. The fact that they're owned by an innocent third party would have made the forfeiture difficult. In the same way you can't forfeit a leased house or apartment being used for drug trafficking, you can't forfeit a leased server. Still, without their equipment for an extended period of time those companies are toast.

Instead they seized the data on some of the servers; most likely what they needed to prove their case. At the end of the trial they simply delete that data and never have to go through any forfeiture proceedings. The companies keep their equipment and can lease it to someone else.

In other words, it's nothing at all like pirating content.

It's things like this that make me wonder why any businesses stay in California in the first place. Companies like Google and Apple could probably build a new facility and pay to move all of their employees and still come out ahead in a year or two if they moved to a place like South Carolina. Not to mention the lower cost of living could probably save them even more on salaries.

In other words, you shouldn't be receiving donation solicitations just because you've written to his Congressional office. More than likely your name and address ended up on that list for other reasons.

I'm sure I could set some arbitrary benchmarks of manhood that I live up to and you don't, but what's the point? The fact is there are people out there that do certain things faster than I can for almost nothing more than what it would cost me for the materials. It would be foolish of me not to take advantage of that situation. But I guess it's not manly to actually use my brain and figure out how much better off I am that there are people out there that will change my oil for a nominal fee, saving me the time and effort spent on something I have no desire to do.
