Well, I can't imagine the guy actually has a federal trademark registration for that thing. So, at the very least, he could probably face some federal penalties for fradulent use of the registered trademark symbol.
the saddest part of the story is that the guy selling the fake shirts never got to buy a ton of lap dances at Mons Venus with the money he made from those shirts.
