@Juancho: if she purposely swerved, there was intent to injure. If she slammed on the brakes, then she can claim she was surprised and tried to stop. This could be a brutal case on top of an already horrifying event.
@Blast it, Biggs: He could have been trying to beat her and she was trying to get away. That's just speculation but if he was after her, screaming from the bed of the pick-up, I'd be swerving too if I were in her shoes.
Sadly, I've known more than one person who has driven a car with someone goofing around or hanging out/on the roof or a window that has caused serious injury/death. To say it's not a good scene is an understatement, to say the least.

I understand the sympathy for Henry, obviously.....but I don't see how charging the fiancee with a crime in this situation helps anyone. Especially the kids, who would then be effectively orphaned.
