Has there ever been a string of punishments/non-punishments more baffling than Roger Goodell's recent run? Lacking a clear directive but wielding the personal-conduct policy like Zeus's discriminate lightning bolts, no one plays unless the Commish decides he's "ready," and the Commish doesn't have to justify himself to you. By choosing not to suspend Aqib Talib or Kenny Britt for actual crimes, it looked like he was admitting his jurisdiction was limited by the lockout. There was something predictable about Oakland's selection of Terrelle Pryor in today's supplemental draft, and it wasn't the pick itself: it was the mad rush among pundits to point out the inevitability of the Raiders taking a guy with a spotty past. It's the laziest sort of joke, and one your 50-something-year-old local columnist will be making tomorrow morning. The Raiders are dirty and they're a bunch of criminals and Pryor will fit right in. Except it's an outdated stereotype and not particularly accurate. The Raiders' reputation dates back to a bitter Chuck Noll "criminal element" quip from 35 years ago, and isn't backed up in the police blotter. In the last decade, the Raiders have had three players arrested on felony charges, and immediately cut ties with two of them. (The third had his charges dropped.) More »

The NFL announced today it will essentially suspend Terrelle Pryor, a player who isn't in the NFL, for violating rules that aren't the NFL's. This is really incredible, and the most incredible part is that what should happen in a sane and just world—Pryor hires a very good attorney who buries the NFL, and for that matter the NCAA, in a hail of torts—most likely won't. I'm guessing the NFL would argue that the league's power to punish players for breaking the rules of the NCAA, a totally separate organization, falls somewhere under the NFL's non-statutory labor exemption, which is the gift owners received because American jurisprudence couldn't give them Green Lantern's power ring. The NFL would argue that ritual cannibalism falls under the non-statutory labor exemption, and they'd win that case, too. More »

The most shocking image of the college football weekend occurred in the second half of Missouri-Nebraska. And it had nothing to do with the fact that Missouri hung 52 on Nebraska before the third quarter ended. It was finding out that Missouri’s chubby and short quarterback who will win the Heisman Trophy is boyz with Warren Buffett, the sage of Omaha. As if that weren’t enough, they posed for photos with one another. Well, of course they did. And of course the two regularly exchange email messages as well. Does Warren Buffett use emoticons? Just because their season came to a crashing halt last weekend it doesn't mean it's too early to start setting things up for next year. After three games, including one crushing loss at USC, Jim Tressel has "finally" handed things over to Terrelle Pryor, the superhuman frosh who gives Ohioans yet another reason not to abandon the state (I believe they're up to three at last count)*.
