If you read the ESPN "book" that chronicled the Mike Tirico and Karie Ross problems, you would know that ESPN is super-sensitive to any sexual harrassment issues brought to them by female employees.

How Tirico gets three months off for horny emails to staffers, and Reynolds gets dumped probably has a lot to do with the fact that Mike was fulltime, and gets the old warning, suspension, and second chance. Unfortunately, as a contractor, HR does not have those rights.

In ESPN company training, they ask you to ask yourself one question before doing something that might be construed by others as sexual harrassment. That is, would I do this to a male employee?

Common law in the U.S. provides for (and most state statutes reinforce, as far as I know) employment to be an "at-will" arrangement, and short of discrimination, an employer can fire you for just about any reason at all (or no reason, for that matter). Section 16 doesn't say ESPN can fire HR *only* for those purposes, so the argument would likely be that these examples are specific instances ESPN has the right to act on, but do not limit their common law rights.

HR's best case is probably not the contractual provisions, but making a case that his firing was discriminatory in some manner (age? race? other?). In the absence of that, I suppose he could argue that Section 21 overrides the ability of ESPN to assert the common law at-will doctrine... but that's extremely boilerplate language put in every legal document, meant to negate any argument of other oral agreements that would conflict with the written contract.

This section's reference to firing without cause if 'roldie commits "willful or egregious ... acts of moral turpitude" is very vague but still a pretty high threshold. I think Harold's alleged hugging doesn't meet that test.

In another context that I'm familiar with (don't ask), the term "moral turpitude" has been read to require at least a felony, violent behavior or illegal drugs. Boston Market is pretty lame but it's none of those things.
