Yes, BruinEric, I think this will be good for thebiglead in the long-term, good point. But, we're talking months for it to be a benefit. In the short-term, we're talking expense and inconvenience. What bothers me is that Colin clearly meant to harm the site; there was no mixed message in what he was saying/doing. I don't even think he actually knows what the site does, either, if you listen to the MP3; this hit was ordered by someone else, in my opinion. That is what is so bothersome.

Thanks a lot for the transcript. Hard for me to get all freaked out about this -- because aren't most blog site owners checking their sitemeter several times a day hoping for traffic?

If I had a sports blog and a radio guy on a national network plugged my site (with positive OR negative publicity), I'd be happy. If my site couldn't handle the load, I'd be frustrated, but would hope that I could monetize some of that traffic, draw repeat visits, and build an audience.

I can't imagine people actually pulled a "real" DoS on this site, whereby they ran hacks to artificially reload the site over and over. I assume these were real visits.

Most site owners are out there begging talk show hosts to pimp their blog. Some try to sneak sitenames in during calls, etc. I've never visited the "Big Lead" ... but I will now!

Another strange thing is that in LA, there's a phone line that goes straight to an answering machine at his affiliate where you can leave messages about why you love him and his show so much. They then play the messages as promos throughout the day.

Well, I heard the show today (small market city...nothing else on the damn radio quite honestly). I don't have time to read 180+ comments, but Cowherd told the listeners to to go The Big Lead, all at once. On the air, he stated he picked that simply because that is a site his producer is on quite frequently. Nothing about anything the Big Lead wrote about him...is it the truth? Did they write some story about him or something?

Anyway, I don't know much about DNS/DdoS attacks, and I really don't care...I didn't know that telling people to go to a website was considered a denial of service attack. Learn somethin' every day!

Jumping in late to the party, but 18 USC 1030(5)(A) and (B) provide the legal ramifications of DNS/DdOS attacks, depending on how much revenue is lost.

There have been convictions of it before, there will be again, and I believe, if I recall correctly, there's provisions in there for civil suits.

The best part of the segment is that whomever the other guy is clearly senses this is not a good thing to do. You hear him be very hesitant when Cowherd is looking for support on this. When Amanda tells him about it, the guy says "I've never heard of it." I don't know who he is, but his voice is extremely hesitant throughout the three minutes. The only thing missing is hearing him say, "I don't know, Davey!"

Yinka: What's interesting is that the AFA tells its lemmings to file a complaint, but the FCC will ignore it. When the FCC releases the number of complaints, they immediately discount the form complaints (in fact, they usually identifiy how many 'legitimate' complaints they received versus 'form-letter' complaints from people who freely admit they didn't actually watch the program in question, but were told it was bad and should be complained against.

This goes back to the standard for bringing any legal complaint before a court: you have to be personally afflicted (or "have standing," as the lawyer kids like to say) before a court will hear your complaint.

That said, this almost certainly won't qualify as indecent, profane, or obscene (in addition to being a lawyer, I worked on radio for 4 years).

But I can't fathom that exhorting your audience to basically break a website and deny the owner of same advertising revenue and such for some time is completely unactionable, and I'm pretty sure the FBI among others would be quite interested.

@Mob Penguin: Sorry been away for a bit, but yes, Kellerman is on ESPN Radio here in NYC. I've always kind of liked the guy. Talks and is knowledgable about boxing which you don't hear much about, can be pretty entertaining. Just wish I could see those old public access shows. He's also now on some HBO boxing broadcasts.

What makes the Eddie Guerrero thing even more absurd, though, is that he brought that example up today himself, except taking the exact opposite stance. Today he was saying that Guerrero's death was a legitimate topic for his show, since it was a controversial death and people were interested in it. Eddie Robinson, on the other hand, is interesting to nobody, and therefore undeserving of time on his show.

The WFAN culprit is Steve Somers, as much I as regret to mention it. He rather brazenly lifted content directly from this very site about a month ago. Not just one Deadspin post, but two - in the same monologue.

For starters, he used - verbatim - references to "Bugs Bunny's pachydermous percussion pitch," and the comment, "Jose Canseco throws many pitches never before seen by humans." (The latter is particularly baffling; this comment was a link to a site that detailed Canseco's pitching debut, and the comment without the context could not have made much sense to listeners.)

The other transgression was the borrowing of language about how Don Nelson chose Door #3 - getting ejected late in a close game with the Wizards.

I was listening to this when it happened on Sirius on the way to class (ESPNews was on commercial), and in the lead up to announcing the site, I thought for SURE it had to be Deadspin. That is, until they said 'only media people use it.' They talked about the Big Lead as if it were a tiny little cute site, and Cowherd was the Vader who was going to destroy it for daring to mock him. It was very analogous to Star Wars, actually, and it pissed me off. Cowherd is horrible and elitist ("That's why I work at a big media place like ESPN and you don't). Colin Cowherd is horrid, worse then anyone on ESPN. God, he pisses me off.

Can I just make the argument, not because I like Cowherd or the WWL, but because I don't want to see the Deadspin crew playing the same dirty pool that Cowherd allegedly called for.

If you're gonna call in, don't start yelling or saying stupid/silly things, instead press him on what gives him the right to call for doing something like a DNS attack on a website. Make him defend his position. Force him to own up to the fact that he used his position in the national media to go after a website because he didn't like what was said about him. Press him on the issue, put him on the defensive. You keep the high ground and you make him realize he was wrong, or make the listener realize it.

@LingeringBursitis: I couldn't find a clear answer to yes or no on U.S. law. However, I know that the Feds are interested as part of U.S. CERT whenever someone violates a site's explict security policy. While you may not be able to to nail the person who actually created the DoS attack, they would most definitely be interested in the person who suggested such an attack take place, even if its not a true quid pro quo.

Further, The Big Lead could argue that they suffered damages because of this (loss of advertising, etc.). IANAL, but I'd sure be happy to pony up $25 to The Big Lead to help them find one.
