Imagine, if you will, this hypothetical situation:

(1) Walsh says he "may" have some "embarassing" information about the Pats, but won't talk unless he's given full indemnity.
(2) The NFL gives him full indemnity.
(3) Walsh goes on the record: "Well, here's this video camera I stole. It may have been used to tape the Rams stuff; I don't know, because I didn't make that tape. All I have are these other illegally-recorded phone calls with Pioli talking about what jerks (players X, Y, Z and agents A, B, C) are."
(4) Players X, Y, and Z either fail to resign as free agents, or turn down offers that were likely to be accepted in the absence of the phone call disclosure, or agents A, B and C never allow their clients to negotiate with the Pats or something.
(5) The Pats sue Walsh for the damages caused by the disclosure of wrongfully-recorded phone calls, which had an expectation of privacy.
(6) He loses.
(7) The NFL pays.

That's the sort of thing I expect is going on here. Walsh is using the Spygate thing as a pretext to get someone to indemnify him against some other potentially tortious conduct on his part. Just a hunch.

Because if you're telling the truth, anyone will indemnify you, because there's virtually no risk: even if someone sues you wrongfully, you'll win, and can (theoretically) countersue them for damages. Which is why the fact that Walsh's attorneys haven't accepted the reasonable and normal indemnification offered by the NFL (which boils down to "we'll cover you for any damages or legal fees incurred by you because of the disclosure of accurate information") makes the whole thing very suspicious.

Indemnification is a contractual arrangement, and would be respected by every court. If I agreed to completely indemnify you (and signed an agreement stating it) for any liability arising from, say, your stay in a Holiday Inn, you could go and do $20,000,000 of damage to the Holiday Inn, and if they sued you to recover, all your attorney would do would move to add me as a party, submitting the indemnification agreement. The case would then be tried, you'd lose, and there'd be a $20m judgment entered in against both of us jointly and severally. Then, your attorney would move to relieve the liability against you, again using the indemnification agreement, and you'd be off the hook 100%. The only "out" for me would be if the indemnification itself was prohibited by state law somehow.

@the other Deadspin, LLPers here: Is it just me, or is your legal spidey sense going zonkers on this Walsh character? You have this former low-level employee guy who won't say what he has, or even if he has anything relevant (he only says he has material that "could be embarassing to the Patriots" -- which, for all we know, could be video evidence that Teddy Bruschi has a small dick), who was fired by the team, who wants complete indemnity from all liability relating to his association with the Pats.

For you non-lawyers, what Walsh is essentially asking the NFL to do is the equivalent of you being asked to give a gun to someone you don't know, then serve whatever jail time arises out of whatever crimes that person may commit with that gun. Would any of you agree to that? Of course not; you'd be insane to do so. In the same way, the NFL would be insane to agree to Walsh's stated terms.

I'm getting the strong vibe that Walsh stole stuff from the Patriots -- specifically, I suspect he stole at least a video camera from them. And that he's using this "information" that he "may" have to get out of any liability relating to what he stole. In any event, there's no reason for him to want "total indemnification" unless he's already done something tortious. If he just had a story to tell, the NFL's offer -- which would basically indemnify him against any claims relating to truthful statements made by him -- would have been more than sufficient.

There's definitely something this guy's hiding -- and it probably ain't Rams tapes.
