Brian Downing, Krystal Restaurant Named In "Alabama Teabagger" Lawsuit
Remember Brian Downing? He's the gentleman alleged to have been caught on video performing a certain sexual act on a passed-out LSU fan in the hours after the BCS Championship game this year in New Orleans. That act, which the New Orleans Times-Picayune describes as "placing his testicles on the LSU fan's neck," has finally resulted in a lawsuit filed last week in the Orleans Parish Civil District Court.
Claiming "mental anguish, humiliation, embarrassment, anxiety and depression," the victim is seeking unspecified damages against Downing. Also named in the complaint is the Bourbon Street Krystal restaurant at which the incident occurred, with the dispute alleging Krystal "failed to undertake appropriate and reasonable measures to provide safety and security."
Downing turned himself in to New Orleans cops months ago, but he's yet to be charged with a crime. It stands to figure the victim's chances at recovering damages hinge somewhat on whether a crime's shown to have occurred; at the same time, NOLA police seem to be busy investigating the 67 murders that have taken place in the Crescent City so far in 2012.
