The Massachusetts Gaming Commission has fined PENN Sports Interactive, operator of ESPN Bet, $15,000 for a violation of the state’s sports wagering advertising regulations. The penalty follows comments made by ESPN host Rece Davis during a March 2024 broadcast of College GameDay, in which he referred to a wager as a “risk-free investment.”
Regulators determined the statement was misleading and in breach of rules prohibiting advertising that suggests guaranteed or risk-free outcomes in sports betting.
The term “risk-free” was commonly used by sportsbooks several years ago as part of promotional offers. These campaigns typically promised that a bettor’s first wager would be matched or refunded up to a certain amount if it lost. Over time, however, regulators and responsible gaming advocates raised concerns that such phrasing could mislead consumers by implying that betting carried no real risk.
In response, operators have since replaced “risk-free” language with alternatives such as “first bet insurance” or “no sweat bet” to better reflect the inherent uncertainty involved in gambling.
The MGC emphasized this point in its ruling, stating that no wager should ever be characterized as “risk-free,” as it suggests a guaranteed or fail-safe outcome.
This distinction formed the basis of the MGC’s decision to fine ESPN BET after Davis used the term during College GameDay. The commission argued that such statements contradict responsible gaming principles and could undermine public trust in regulated sports wagering.
With major media organizations like ESPN partnering with operators such as PENN to run branded sportsbooks, sports betting content has become increasingly integrated into live broadcasts and studio shows. As a result, discussions about wagering are now appearing alongside traditional sports analysis.
However, this blending of editorial and betting content can create challenges. Many on-air personalities are experts in sports, not in the regulatory or responsible gaming aspects of wagering. This gap became evident when Davis used the term “risk-free bet” during College GameDay.
The incident highlights the importance of ensuring that broadcasters and analysts who discuss betting are properly trained in responsible gaming principles and appropriate terminology. Clearer guidance and education can help prevent misinformation, maintain audience trust, and support efforts to promote safe and responsible gambling behavior.
This isn’t the first time that the MGC has issued a fine to a prominent operator. Earlier this year, the MGC fined DraftKings $450,000 for allowing 1,000+ bets that were funded by credit cards. This form of payment is not permitted within the state, which is why actions were taken.
The commission’s consistent enforcement actions reflect its broader commitment to responsible gaming and consumer protection. By holding operators accountable, the MGC aims to set a high standard for transparency, marketing integrity, and adherence to state regulations. These measures not only safeguard bettors but also reinforce public confidence in the state’s newly regulated sports wagering market.
