Virginia’s 2026 legislative session concluded without a compromise on proposals to legalize online casinos, leaving supporters of iGaming to wait until at least next year for renewed discussion. A conference committee tasked with reconciling the House and Senate versions of the legislation was unable to resolve differences between the two bills. Both chambers stood by their preferred structures for regulating and taxing online casino operations, ultimately allowing the session to end without a unified approach.

Notably, the lack of agreement does not immediately change the timeline for potential market launch. Both bills contained reenactment clauses, meaning any approved legislation would still require a second vote in 2027 before implementation could begin. Without action this year, any Virginia online casino rollout is now pushed to 2028 or beyond.

Differing tax distribution plans were a major sticking point

The two bills—Senate Bill 118 and House Bill 161—shared many structural components but differed significantly on how to distribute tax revenue generated from online casino operations. SB 118 planned to direct most funds toward the general fund, while HB 161 proposed funneling a large share into a new Modern Public Education Fund. Both plans assumed a 20% tax on adjusted gross revenue but varied on secondary allocations and how additional taxes would support land‑based casinos facing possible revenue cannibalization.

Other differences included promotional credit rules and eligibility criteria for local business participation. The House bill, for example, included a requirement that at least 25% of promotional revenue be redeemable at the partnered land‑based casino—language not mirrored in the Senate version. These discrepancies contributed to the breakdown in negotiations.

Sweepstakes casino ban efforts also stalled

This legislative session also saw attempts to ban sweepstakes casinos, but those efforts ultimately failed as well. A standalone bill aimed at prohibiting sweepstakes casinos did not make it out of the Senate, while broader online casino bills that included similar language stalled alongside the rest of the iGaming package. Lawmakers did not clarify whether any sweepstakes ban would have been affected by the reenactment clause.

The result leaves sweepstakes businesses operating for at least another year, maintaining the status quo in an already fragmented gaming environment. The continued legality of these operations remains a point of debate among legislators concerned about consumer protections and regulatory oversight.

Only one gaming bill passed during the session

Amid the stalled progress on online casino legislation, lawmakers did approve one gaming-related measure: HB 145. The bill imposes a 10% tax on fantasy sports operators and prohibits contests that allow players to compete against the house. It also imposes a $50,000 licensing fee on participating fantasy platforms. The measure now awaits review by Gov. Abigail Spanberger, who has 30 days to sign, amend, or veto it.

With iGaming discussions delayed and the proposed Virginia Gaming Commission failing to advance, lawmakers are expected to revisit the broader regulatory framework in 2027. For now, Virginia’s push toward online casinos pauses once again, underscoring ongoing concerns over revenue distribution, regulatory readiness, and the social impacts of expanded digital gambling.
